Terms of Service
The rules and guidelines for using the LinkToast platform and services.
These Terms of Service ("Terms") govern your access to and use of the LinkToast platform and services ("Service"). By using LinkToast, you agree to these Terms.
1. Acceptance of Terms
By accessing or using LinkToast (the "Service"), you agree to be bound by these Terms.
If you create an account or use the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
If you do not agree with these Terms, you may not use the Service.
2. Description of the Service
LinkToast provides a platform that enables businesses to create profiles, present verified relationships, and display network-based credibility information.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. User Accounts
To access certain features of the Service, you must create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to ensure that the information associated with your account is accurate and kept up to date.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Business Representation and Authority
By creating, publishing, or managing a business profile on LinkToast, you represent and warrant that:
- You are authorized to act on behalf of the business or organization listed
- All information submitted is accurate, current, and not misleading
- You do not falsely claim partnerships, affiliations, endorsements, or relationships that do not exist
- You have the necessary rights to upload logos, trademarks, or other brand materials
Business profiles may be subject to verification, including domain ownership confirmation or other reasonable validation methods.
LinkToast reserves the right, at its sole discretion, to suspend, restrict, or permanently remove any account or business profile that involves impersonation, fraudulent representation, or materially false information.
5. Business Verification
Certain features of the Service may require verification of business identity or domain ownership.
LinkToast may delay, limit, or prevent the public display of a business profile until verification requirements are satisfied.
We are not obligated to approve, verify, or maintain any business profile.
6. Prohibited Uses
You may not use LinkToast:
- In any way that violates any applicable law or regulation
- To upload false, misleading, or deceptive information
- To impersonate or attempt to impersonate another person, business, or entity
- To transmit malicious code or harmful content
- To interfere with the integrity, performance, or security of the Service
- To engage in automated scraping, crawling, or data extraction without prior written consent
7. User Content
You retain ownership of the content you submit to the Service, including business information, logos, and descriptions ("User Content").
By submitting User Content, you grant LinkToast a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content solely for the purpose of operating, improving, and promoting the Service.
You are solely responsible for the content you provide.
8. Intellectual Property
The content and materials provided by LinkToast, including but not limited to software, design, text, graphics, and branding, are the property of Always Cold In Space OÜ or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on the Service without prior written permission.
9. Payments and Subscriptions
Certain features of the Service may require payment.
If you subscribe to a paid plan:
- You agree to pay all applicable fees
- Fees are non-refundable unless otherwise stated
- Subscriptions may renew automatically unless canceled prior to the renewal date
We reserve the right to modify pricing. If we increase prices for existing subscriptions, we will provide at least 30 days' advance notice by email or in-app notification. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we determine to be harmful to the integrity of the platform.
Upon termination, your right to use the Service will immediately cease, and we may remove or disable access to your account and associated business profiles.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
LinkToast makes no warranties, express or implied, regarding the accuracy of user-submitted information, the availability or uninterrupted operation of the Service, or the validity of relationships claimed by users.
Your use of the Service is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law, LinkToast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
In no event shall LinkToast's total aggregate liability exceed the amount paid by you to LinkToast in the twelve (12) months preceding the claim.
Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia.
If you are a consumer located in the European Union, you may also be entitled to rely on mandatory consumer protection provisions of your country of residence.
14. Dispute Resolution
Before initiating any formal legal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@linktoast.com. We will make good-faith efforts to resolve the issue within 30 days.
If informal resolution fails, disputes shall be submitted to the courts specified in Section 13. EU consumers may also seek assistance through their national consumer protection authority or an accredited dispute resolution body in their country of residence.
15. Force Majeure
LinkToast shall not be liable for any failure or delay in the performance of the Service resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, labor disputes, government actions, internet or power outages, cyberattacks, or failures of third-party service providers.
In such circumstances, our obligations are suspended for the duration of the force majeure event. We will notify you of the event and resume performance as soon as reasonably practicable.
16. Cookie Consent and Optional Analytics
Some parts of the Service rely on cookies to function properly. Optional analytics cookies are managed through our cookie consent layer. Analytics processing is activated only after the relevant consent is granted and can be withdrawn later through Cookie preferences.
Your continued use of the Service does not override cookie choices you make in the consent banner. For details on analytics categories and processing, see our Privacy Policy.
17. Account Deletion and Data Subject Rights (GDPR/CCPA)
Users may request deletion of their account at any time through the LinkToast platform.
To complete an account deletion request, users must:
- Enter the system-generated confirmation string
- Verify account ownership by entering a one-time verification code sent to the registered account email address
Once both verification steps are successfully completed, the deletion request is executed immediately.
Account deletion is permanent and cannot be undone. Upon deletion:
- All associated companies, widgets, and relationship data are removed from active platform systems
- Any active widgets embedded on external websites may stop functioning or display incomplete data
Where required by applicable law, users may exercise additional privacy rights, including the right to access, correct, or receive a copy of personal data, and the right to non-discrimination for exercising privacy rights. Authorized agents may submit requests where legally permitted, subject to identity and authorization verification.
LinkToast may retain certain records where required or permitted by legal, regulatory, or financial obligations, including but not limited to invoices, billing records, and fraud prevention logs, as further described in the Privacy Policy.
18. Business (Company) Deletion
Users may delete individual businesses associated with their account.
To complete a business deletion request, users must complete the same verification process:
- Enter the system-generated confirmation string
- Verify the request by entering a one-time verification code sent to the associated business email address
Business deletion is permanent and cannot be undone. Upon deletion:
- All data related to the deleted business, including widgets and relationships, is removed from active platform systems
- Any websites using widgets linked to the deleted business may be affected
- Depending on the features available under your plan, LinkToast may notify other businesses that have an existing relationship with the deleted business that the business has been removed from the platform
- Where applicable and where technically feasible, LinkToast may inform such businesses which entity has replaced the deleted business within affected widgets, in order to maintain continuity and proper functioning of those widgets on third-party websites
Certain records may be retained where required or permitted for legal, regulatory, financial, security, or compliance purposes, as further described in the Privacy Policy.
19. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will update the "Last updated" date above and, where required by applicable law, notify you by email or in-app notification. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Always Cold In Space OÜ regarding your use of the Service and supersede any prior agreements.
